Notional Estate Orders

Sometimes a person deals with or disposes of their assets while they are alive so that the assets do not form part of their Estate or the assets may have been distributed from the Estate (relevant property transactions).

This sometimes occurs where children/relatives become estranged or where one child/relative  is preferred by a parent or influences them in arranging their affairs. There may be other instances.

In certain limited circumstances, the Court can make orders against the Notional Estate of the deceased. This means that certain transactions like transfer of property or assignment of investment or cash can be traced and brought back into the Estate.

There are strict time limits for these types of claims which are often factually complex and difficult.
